BY ACCESSING OR USING THE SERVICES—INCLUDING GENERATING AI-BASED 3D MASCOTS, SUBMITTING CREATIONS TO THE GALLERY, OR PARTICIPATING IN OUR COMMUNITY COMPETITIONS—YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES.

1. General Overview

1.1 Nature of the Platform

xAIM is a blockchain-driven creative ecosystem designed to support and empower a 3D creative community. Our Services allow users to:

• Generate AI-powered 3D mascots using ChatGPT 4.5 and Meshy.ai API.
• Submit their mascots to the xAIM Mascot Gallery for public display.
• Participate in a game competition, where a winning mascot is selected.

Unlike traditional blockchain projects, xAIM does not require wallet connections, personal data, or financial transactions.

1.2 Scope and Applicability

These Terms govern your use of our Services, including all content, interactions, and AI-generated outputs. Your use of our Services is also subject to our Privacy Policy, which is incorporated by reference.

1.3 Acceptance of Terms

By using our Services, you agree to these Terms. If you do not agree to any provision, you must stop using xAIM immediately.

2. AI-Generated Content and No Professional Advice

2.1 AI-Powered Operations

Our Services leverage autonomous AI models (including ChatGPT 4.5 and Meshy.ai API) to generate 3D mascots based on user prompts. AI-generated outputs are unpredictable and may not always be accurate, complete, or error-free.

2.2 No Assurance of Accuracy

All AI-generated mascots and content are for creative and entertainment purposes only. You acknowledge that AI outputs may contain inconsistencies or inaccuracies and that xAIM is not liable for any resulting issues.

2.3 Future Features and Development

Regarding planned features and development:

• Interactive battle royale games are planned to be implemented after the first tournament concludes.
• No specific timeline or delivery date is guaranteed for any future features.
• All planned features are subject to change or cancellation without prior notice.

3. Acceptable Use

3.1 Lawful and Responsible Use

You agree to use xAIM solely for lawful purposes and to comply with all applicable laws and regulations.

3.2 Prohibited Activities

You must not:

• Attempt to hack, disrupt, or interfere with xAIM's operations.
• Submit inappropriate, offensive, or unlawful content.
• Use AI-generated content for fraudulent, deceptive, or illegal purposes.

Failure to comply may result in permanent suspension from xAIM.

4. Privacy and Data Practices

4.1 No Collection of Personal Data

xAIM does not collect, store, or process:

• Wallet addresses or blockchain transactions
• Personally Identifiable Information (PII)
• Payment or financial information

4.2 Limited Data Collection for Performance

We collect only non-identifiable technical data, such as:

• Browser type, device information, and platform usage patterns
• Anonymous analytics to improve AI performance and platform efficiency

All interactions remain anonymous, and data is used only to enhance user experience.

5. Intellectual Property and User-Generated Content

5.1 Ownership of AI-Generated Content

Users retain rights to the mascots they generate, but by submitting them to the xAIM Gallery, you grant us permission to:

• Display and showcase your mascot publicly.
• Use submitted mascots in promotional or community materials.

5.2 Platform Ownership

All platform content, including logos, branding, and AI technology, is owned by xAIM or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.

6. Limitation of Liability

6.1 No Liability for AI Output

To the maximum extent permitted by law, xAIM, its developers, and affiliates are not responsible for:

• Any inaccuracies, errors, or unexpected results from AI-generated mascots.
• Any technical issues, service interruptions, or lost data.

6.2 Assumption of Risk

By using xAIM, you acknowledge and accept that:

• AI-generated content is experimental and may contain flaws.
• Any participation in gallery submissions or competitions is at your own discretion.
• xAIM does not guarantee the continued availability of any Services.

7. Indemnification

You agree to indemnify, defend, and hold harmless xAIM, its developers, and affiliates from any claims, damages, or liabilities arising from:

• Your use of AI-generated content.
• Your participation in xAIM's gallery or competitions.
• Your violation of these Terms.

8. Right to Restrict or Terminate Access

xAIM reserves the right to suspend, restrict, or terminate access to the Platform if:

• A user violates any of these Terms.
• A user engages in abuse, fraud, or misconduct.

Such termination is at our sole discretion and may occur without prior notice.

9. Modifications to These Terms

We reserve the right to update these Terms at any time. Changes will be posted with an updated "Last Updated" date. Continued use of xAIM after modifications constitutes acceptance of the revised Terms.
